Terms of Use

1. Scope and object of the contract

1.1. These General Terms and Conditions of Contract regulate the relationship between Sweet home Lugano (hereinafter SHL) and the Client in relation to the provision of accommodation Services selected by the Client in the booking proposal made from among those offered by the Structure, which can be viewed on the website www.sweethomelugano.smoobu.net.

1.2. The request for the provision of Services may be made by the Client by submitting the Booking Proposal to SHl by: sending an email to the email address orla1970@hotmail.com or; by telephone, in verbal form, by contacting the number +41 764170470; by means of the online booking procedure present on the website.

1.3. The contract is concluded when the customer makes the Booking Proposal in the manner stipulated in Section 1.2. and brings it to the attention of the SHL. The actual conclusion is always subject to the availability of the Service. This confirmation shall be provided by the SHL upon receipt of the Booking Proposal or immediately thereafter.

1.4. If the activation of the Services cannot take place due to impediments for which the SHL is not responsible, the agreement shall be automatically terminated without any liability of the SHL towards the customer.


2. Activation and provision of the Service.

2.1. Upon activation of the Service, SHL shall guarantee the Client: - the use of the housing unit of the type defined in the Proposal. - internet connection, weekly tidying up and change of linen, and any service provided for by the regional B&B law in force.

2.2. the B&B shall give the Client on loan any other accessory equipment for the complete enjoyment of the chosen Services (keys, cards, etc.).

2.3. The Client shall use the Rooms, common areas and equipment in such a way as not to disturb the normal performance of the Service and third parties accommodated in the facility. The customer shall be exclusively liable for any direct damage resulting from the breach of this obligation, and shall hold SHL harmless from any consequences, costs or charges.

2.4. The customer shall indemnify SHL against any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by SHL, and shall also indemnify SHL against any action, reason or claim brought by third parties against SHL that are caused or motivated by behaviour and/or omissions that are in any case attributable to the customer or that are in any case the consequence of the customer's failure to comply with and/or violation of the provisions of these General Terms and Conditions.

3. Booking and Payment.

3.1. In the case of Reservation for a future date, the B&B requires the Client to pay in advance

3.2. Failure to pay the amount due within the aforementioned terms will result in the forfeiture of the reservation, without the need for any communication from SHL.

4. Duration of the Contract, Cancellations and Penalties.

4.1. The Contract shall be valid and effective from the date of the conclusion of the Contract and shall terminate if both of the following conditions are met: - the Client and any third parties connected to or employed by the Client have left the SHL Housing Facility permanently; - the Client has paid the full amount due from SHL.

4.2. Check-in must take place between 16:00 and 20:00; there is no possibility of using the facility before this time. Any arrivals outside these hours must be agreed in advance with SHL. Failure to give prior notice may result in long waits for which no claims or refunds will be accepted. Check-out must strictly take place by 10:00 a.m., if this does not occur, an additional night will be charged.

4.3. the guest has the right to cancel the booking and terminate the contract within the terms of the times stated in 3.1. No reimbursement shall be provided for a guest who leaves SHL prematurely for any reason whatsoever.

5. Protection of privacy.

5.1. The customer is informed, in accordance with the Data Protection Act nLPD dated 1.09.2023, that the processing of personal data provided by SHL is necessary in order to enable SHL directly or through third parties to fulfil its obligations arising from this contract or for the fulfilment of its obligations under the Act or regulations.

5.2. The data controller shall be the legal representative of SHL.

6. Documents.

6.1. Upon arrival at the B&B, you must hand over valid identity documents (Passport, Identity Card) necessary for the registration required by law. Failure to comply with this obligation constitutes a violation of the penal code and entitles us to demand the immediate abandonment of SHL. Our guests' data are processed in accordance with current privacy legislation.

7. Liability of the B&B.

7.1. SHl shall be liable for the non-performance of the contract and the provision of the Service exclusively for an act attributable to SHl.

7.2. If the customer on arrival notices a different Service than the agreed Service but accepts it anyway, he/she shall be automatically forfeited from any claim for compensation and the new Service replaces, by agreement of the parties, the previously agreed Service.

8. Limits of liability.

8.1. SHL shall not be liable in the event of delays, inconveniences, malfunctions and/or interruptions of the Service due to - unforeseeable circumstances or force majeure; - tampering with or intervention in the service or the equipment carried out by the customer or by third parties not authorised by SHL; - damage or inconvenience caused by the total or partial interruption of the electricity or water supply; - SHL shall not be liable for any valuables owned by the customers and brought into the premises.

9. Management recommends:

9.1. Silence/Children. Total silence must be observed from 11:00 p.m. to 8:00 a.m..; it is forbidden to enter private areas of the B&B (see signs); Children must always be accompanied by an adult person. In any case, behaviour must be maintained so that at no time of the day and in no way detracts from the tranquillity of others.

9.2. Cleaning. Rooms are cleaned weekly. The flat must be vacated by 10 a.m. for cleaning. If the flat is not vacated by 10:00 a.m. the cleaning will be postponed to the next day. You are kindly requested to arrange your personal belongings in such a way as to allow for such cleaning.

9.3. Other Guests. It is strictly forbidden to bring other people into any area of the SHL without the manager's authorisation, under penalty of a surcharge of chf. 250.00 The customer may not sublet or loan the flat, in whole or in part, under penalty of cancellation of the reservation right and a surcharge of CHF 250.00. 250.00.

9.4. Breakfast is not included in the service provision.

9.5. Smoking/Guns/Drugs. It is strictly forbidden to introduce, weapons, drugs and other substances. On penalty of immediate termination of the contract. It is also strictly forbidden to smoke in the entire flat. You may smoke freely on the terrace, strictly using the ashtrays provided there.

9.6. Kitchen. is equipped with everything you need, upon return dishes and all accessories provided must be cleaned and put back in the place where you found them. Rubbish bags once they are full must be left outside (garden) next to the entrance door. If you violate these simple rules SHL reserves the right to charge you more than the normal cleaning procedure you have already paid.

9.7. Personal items. No items of any kind may be left in the corridors or common areas. SHL is not responsible for personal items left unattended. N.B. SHL is not responsible for the loss, theft or damage of your personal belongings left in the flat unattended.

9.8. Animals. It is strictly forbidden to bring in animals of any kind or size.

9.9 . Toilets. We recommend a correct and civilised use of the toilets, avoiding throwing anything in the toilet (use the appropriate bins). In addition, civilised use of the service is expected.
